Terms of Use

Holey: Swallow It All. Effective date: 29 October 2026

These terms are an agreement between you and Digitalsynn Ltd ("we", "us"), a company registered in England and Wales, about your use of the game Holey: Swallow It All ("Holey", "the game"). By downloading or playing the game you agree to these terms. Please also read our Privacy Policy.

1. Who can play

Holey is intended for players aged 13 and over. If you are under 18, please make sure a parent or guardian agrees to these terms and to any purchases.

2. Your licence

We give you a personal, non-exclusive, non-transferable, revocable licence to download and play the game on devices you own or control, for your own non-commercial use, in line with these terms and the rules of the app store you got it from. The game, its art, music, code and content belong to us or our licensors. You must not copy, modify, sell, rent, reverse engineer or redistribute the game, except where the law allows it.

3. Coins and virtual items

  • Coins, boosters, skins, Zen map unlocks, season pass rewards and other items in the game ("virtual items") are a licence to use content inside the game. You do not own them.
  • Virtual items have no cash value. They cannot be exchanged for real money, sold, transferred or traded, and they cannot be used outside the game.
  • Every product sold for real money shows exactly what it contains before you buy. Nothing random is sold for real money.
  • Your progress and items are saved on your device. If you delete the game and have no device backup, they may be lost. See our support page for how backups and restoring purchases work.
  • We may change the balance of the game, such as prices in coins or rewards, to keep it fair and fun. We will not take away an item you paid real money for, except as allowed in section 8.

4. Purchases and refunds

  • The game is free. Optional in-app purchases are sold through the Apple App Store or Google Play. Prices are shown in the game in your local currency before you buy.
  • Payment, billing and refunds are handled by Apple or Google under their terms. We never see your payment details.
  • When you buy a virtual item, you ask us to supply it straight away. Once it is delivered, you lose the 14-day right to cancel that applies to some digital content in the UK and EU. This does not affect your other rights if an item is faulty or not as described.
  • Refunds: request them from the store you bought from. For Apple, go to reportaproblem.apple.com. For Google Play, see Google Play's refund help. If a store refunds a purchase, we may remove the items it gave.
  • Restoring purchases: permanent unlocks, such as Zen maps and skin bundles, and an active VIP subscription can be restored with Restore purchases in the game's Settings, Shop or VIP page. Coins and other consumable items that were used up cannot be restored.

5. VIP subscription

  • Holey VIP is an optional auto-renewing subscription, available weekly or monthly. The price and period are shown in the game before you subscribe.
  • VIP includes: every Zen map while you are subscribed, ad rewards without watching the ad, 500 coins every day, the exclusive VIP Royal skin, and double coins from chests.
  • Free trial: the weekly plan includes a 3-day free trial for new subscribers. Unless you cancel at least 24 hours before the trial ends, it turns into a paid weekly subscription and you are charged when the trial ends. The monthly plan has no trial.
  • Renewal: payment is charged to your Apple ID or Google account when you confirm. Your subscription renews automatically at the same price for the same period, and your account is charged within 24 hours before the end of each period, unless you cancel at least 24 hours before it ends.
  • Cancelling: deleting the game does not cancel the subscription. To cancel or manage it:
  • When you cancel, VIP stays active until the end of the period you have paid for. After that the VIP benefits stop, including access to Zen maps you did not buy separately. Coins and items you already received stay yours.
  • We will tell you in advance about any price change, and the store will ask for your agreement where the law or store rules require it.

6. Rewarded ads

The game offers optional rewarded video ads, served by Google AdMob. You choose whether to watch. If you watch to the end, you get the reward shown, such as a continue, double coins, a free chest or a free booster. Sometimes no ad is available, for example when you are offline or in some regions. We are not responsible for the content of ads, but we limit them to a rating suitable for teenagers. See the Privacy Policy for how ads use data.

7. Acceptable use

Please do not:

  • cheat, hack, modify the game or its save file, or use bots or tools that give an unfair advantage;
  • exploit bugs to gain items, or fake purchases or ad views;
  • try to disrupt the game or our partners' services;
  • use the game for anything unlawful.

If you break these rules, we may stop supporting your copy of the game or remove items gained unfairly.

8. Changes to the game and these terms

We may update, change or, with reasonable notice, stop offering the game or parts of it. Events, the season pass and offers run for a limited time. We may update these terms. If a change is significant, we will tell you in the game. If you keep playing after a change, the new terms apply. If we stop offering the game, we will give reasonable notice and will not stop you using paid items still on your device unless we have to.

9. Our liability

  • We provide the game "as is". We try hard to make it work well, but we cannot promise it will always be available or free of errors.
  • If you live in the UK or EU, you have legal rights in relation to digital content that is faulty or not as described. Nothing in these terms affects those rights.
  • We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
  • To the extent allowed by the laws of England and Wales, we are not liable for loss that was not foreseeable, for business losses, or for loss of virtual items caused by deleting the game, device faults or lost backups. Our total liability to you for anything else is limited to the amount you paid for in-app purchases in the 12 months before the claim.

10. Apple and Google

These terms are between you and us, not Apple or Google. Apple and Google are not responsible for the game or its support. If you downloaded the game from the App Store, Apple's Licensed Application End User License Agreement also applies, and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. If the game fails to match any applicable warranty, you may tell Apple and Apple will refund the purchase price of the app (if any). If you downloaded the game from Google Play, the Google Play Terms of Service also apply.

11. Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, but if you live in Scotland or Northern Ireland you can also bring a claim there. If you live in the EU, you keep the protection of the mandatory consumer laws of your country and can bring a claim in your local courts.
